Terminating a contract. Eek! What are you gonna do? All right well, stick around and Ill tell ya. Hello Simon here from The Contract Company. -Contracts its what we do, all day every day, and sometimes overnight, Lucky us! And thats true. Contracts are interesting. Right, you wanna terminate a contract right. Now, the reason I said Eek is because it is one of the areas of law where you really are exposed if you get it wrong. So lets just step back. How do you terminate a contract? The key thing in terminating the contract is to look at the actual contract and examine the termination clause. Now most of those sorts of clauses, because weve seen hundreds, most of those clauses will set out a process of things you have to do. Usually you have to provide notice, one in writing and of a certain time period, 30, 60, 90 days of notice. The fourth thing you have to do often is send that notice to a key person thats specified in the contract. So it might say that if you want to issue a

Below are some common questions from our customers that may provide you with the answer you're looking for. If you can't find an answer to your question, please don't hesitate to reach out to us.

Simply state the reason or reasons you are terminating your nannys contract. For example, We have terminated your employment as our nanny due to our familys changing needs. Any reasons you include should have already been discussed in person with your nanny.
The notice period within the probationary period is around one week for employees and employers. Once the nannys probationary period ends this can be extended or deferred to the nannys notice period (4 to 6 weeks in the nanny market).
First you must give her reasonable notice of termination. Then you have to calculate all the money (salary, vacation pay owed, possible severance pay) that you have to pay to your nanny, and give her the required documents.
Heres how to fire a nanny, babysitter, senior caregiver or housekeeper responsibly. Identify the issue. Establish clear expectations. Create a paper trail. Make a decision and plan it out. Have the talk. Stay strong, but be compassionate. Answer unemployment questions. Deal with final payment.
Be brief and state only the facts. Let the nanny know about their pay and any severance. If you have a confidentiality agreement, remind them that it covers termination and remains in effect after their employment has ended.
TERMINATION OF EMPLOYMENT: Nanny is an at-will employee and this agreement will continue until terminated by either party. However, both parties agree to provide four weeks notice of intent to terminate this agreement (or pay in lieu of such notice), except when such termination is for cause.
A termination letter or email should include the reason for termination, the effective date of termination, any severance pay or benefits that will be provided, and any instructions for returning company property or completing final tasks. It should also be written professionally and respectfully.
Firing Your Nanny the Right Way Add termination/resignation language to your work agreement. Understand at-will employment. Conduct job performance evaluations. Identify, address and document issues. Ask yourself why you want to fire your nanny. Know when to fire immediately. Set a backup plan for childcare.
