Proper Placement of the Registered Trademark Symbol Its recommended that the registered trademark symbol be used in connection with all registered trademarks. It should either be placed to the lower right (subscript) or to the upper right (superscript) of the actual mark.
You can claim a trademark on anything by using the TM Symbol, but you cant use the registered trademark symbol (R) unless you have registered the trademark with the US Patent and Trademark Office.
You should use TM before you have filed your application with the USPTO and while your application is being considered. Use of the circle R or () symbol is reserved for registered trademarks. You are not allowed to use the circle R before you receive the registration.
The trademark symbol is a symbol to indicate that the preceding mark is a trademark, specifically an unregistered trademark.
Use of the TM and SM symbols may be governed by local, state, or foreign laws and the laws of a pertinent jurisdiction to identify the marks that a party claims rights to. The federal registration symbol, the R enclosed within a circle, may be used once the mark is actually registered in the USPTO.
The (registered trademark) mark or its French equivalent, MD (marque dpose) can only be used once the trade-mark has been officially registered with CIPO. For unregistered trademarks, the (trademark) symbol or MC (marque de commerce) can be used to signify trade-mark ownership.
Trademark Symbol Usage Guidelines Use the TM trademark symbol for marks that brand goods and SM for marks that brand services. Use the TM or SM trademark symbols for unregistered trademarks, including while your application for registration is still pending in the U.S. Patent and Trademark Office.
Use the legally required components in proper order. Use the or symbol at the end of a trademark. Two or more trademarks used together must always be distinguished from each other by using the or symbols on both (or all) of the trademarks each time they are used.
