[Music] hi john stromeier from strom meyer law and today were discussing the differences between an advanced directive a medical power of attorney and a do not resuscitate order now these are all documents that we use as part of the normal estate planning process but they are different and they while they overlap theyre not the same thing first one we want to talk about is the do not resuscitate or dnr order this is used by clients who do not want to be resuscitated if theyre outside of the hospital if theyre in the hospital theres a different in a hospital form that they may have but if youre outside of the hospital the dnr order needs to have a specific form and among other things it needs to have either two witnesses and a notary or or two witnesses or a notary and it must have a physicians signature authorizing that do not resuscitate order if thats in place and something happens to you and it looks like your death is imminent then that dnr order will stop medical personnel

Power of attorney terms defined A general power of attorney could refer to a person or organization that has the power to act on the designees behalf. A healthcare power of attorney allows the designated person or party to make medical decisions on the designees behalf.
While you arent financial liable, as the attorney-in-fact, youre still the point of contact for the principals debts. Creditors have a right to attempt to collect the funds that are owed. They dont, however, have a right to harass you.
What three decisions cannot be made by a legal power of attorney? A power of attorney cannot change or invalidate a will, act outside of the principals best interest, or violate the terms of nominating documents, and cannot make decisions on behalf of the principal after their death.
A medical or health care power of attorney is a type of advance directive in which you name a person to make decisions for you when you are unable to do so. In some states this directive may also be called a durable power of attorney for health care or a health care proxy.
Not Completing and Signing a Health Care Proxy Document If you dont have one medical professionals may have to make decisions in a vacuum. Your wishes may not be respected. Or worse a court might have to get involved to resolve decisions. That might require appointment of a guardian to make decisions in some cases.
In rare cases, a POA can be abused by an agent who tries to take advantage of their power over your affairs, which is a crime, ing to the National Center on Elder Abuse. Thats why its so important to choose an agent you completely trust to act responsibly.
The agent may be given broad or limited authority to make decisions about the principals property, finances, investments, or medical care. POAs can be financial or they can pertain to health care. Both provide the attorney-in-fact with general or limited powers.
A Power of Attorney Could Leave You Vulnerable to Abuse Because of the potential that an agent could take advantage of you or steal from you, it is very important that you select the right person to act as your agent.
