Answer with the Justice Court, an eviction order will be GRANTED and sent to the constable. Landlord files a Complaint with the Justice Court after the 7-day notice period expires. The summary eviction hearing is held, and the Judge makes a decision.
If youre a tenant, and you have been served a Seven-Day Notice to Pay Rent or Quit, you may file an Affidavit/Answer to contest the eviction. The Affidavit/Answer must be filed with the court within seven (7) judicial days following service of the eviction notice.
To file an affidavit/answer, the tenant must: File a completed Tenants Affidavit/Answer in Opposition to Summary Eviction. File a completed Civil Court Cover Sheet if you are not filing in Las Vegas. File all eviction notices served on the tenant. Pay a $71 filing fee.
Nevada law requires a thirty-day notice to the tenant (or a seven-day notice if the tenant pays rent weekly), followed by a second five-day Notice to Quit for Unlawful Detainer (after the first notice period has elapsed) instructing the tenant to leave because tenants presence is now unlawful.
Your notice can always be served by hand to the individual tenant or tenants who live in the property. This is the best method if possible as it gives you the opportunity to have your tenants confirm they have received the notice by signing and dating the document.
After the eviction is ordered, you may file a Notice of Appeal with the court that issued the eviction order. In order to stop the evic- tion pending the appeal, you must post a bond. If you were evicted under the summary eviction procedure of NRS 40.253 that bond amount is set at $250.
The Five-Day Notice to Quit for Unlawful Detainer should tell the tenant: That the tenant can oppose the notice by filing an affidavit/answer with the court no later than the fifth full judicial (business) day after the date the notice was served, (NRS 40.254(1)(c)); and.
