The HIPAA Rules define business associate generally to mean a person who performs functions or activities on behalf of, or certain services for, a covered entity that involve the use or disclosure of protected health information.
Examples of Business Associates are lawyers, accountants, IT contractors, billing companies, cloud storage services, email encryption services, web hosts, etc. (This list could go on for a while.) You are required to have a Business Associate Agreement with these people.
A BAA is a signed document where the business associate takes on the responsibility to keep your clients information safe and explains how it will do so. It also outlines the steps they will take in the case of a bdocHub. HIPAA requires that you get a BAA from every business that could have access to your clients PHI.
At its most basic, BAAs must contain these provisions: Determine what PHI the Business Associate will access. Require that the Business Associate will use appropriate safeguards to secure PHI. Provide that the BA will not disclose protected health information save when permitted by the agreement.
What Is a Business Associate? A business associate is a person or entity that performs certain functions or activities that involve the use or disclosure of protected health information on behalf of, or provides services to, a covered entity.

Compliance with the U.S. Health Insurance Portability and Accountability Act (HIPAA) requires companies that deal with protected health information (PHI) to have physical, network, and process security measures in place and follow them.
A Business Associate Contract, or Business Associate Agreement, is a written arrangement that specifies each partys responsibilities when it comes to PHI. HIPAA requires Covered Entities to only work with Business Associates who assure complete protection of PHI.
A covered healthcare provider, health plan, or healthcare clearinghouse can be a business associate of another covered entity.
As such, a BAA is required any time you are working with a vendor or contractor who will come into contact with PHI on your organizations behalf. Keep in mind, HIPAA requires you to sign the BAA with your business associate before sharing any PHI with them.
