A trademark license is basically an agreement whereby a trademark owner permits someone else to use the owners trademark in connection with specific products or services. Although a trademark license isnt required to be in writing to be enforceable, its strongly recommended that all trademark licenses be memorialized in a written and signed document. Although the terms of every trademark license are different and may be freely negotiated, all licenses must include certain provisions to be valid. Every time you use your trademark, you can use a symbol with it. The symbol lets consumers and competitors know youre claiming the trademark as yours. You can use TM for goods or SM for services even if you havent filed an application to register your trademark.

Principally, there are three symbols that are most commonly associated with signifying trademark rights: Circle R (), TM, and SM. Depending on the nature of the goods/services sold and the status of the trademark application with the USPTO, one or more of these marks may be appropriate.
Federal trademark registration You can use the symbol and you can generally rely on those rights to protect your trademark as you expand your business across state lines. However, the USPTO is not an enforcement agency, so you will be responsible for pursuing any infringing users.
Use of the TM and SM symbols may be governed by local, state, or foreign laws and the laws of a pertinent jurisdiction to identify the marks that a party claims rights to. The federal registration symbol, the R enclosed within a circle, may be used once the mark is actually registered in the USPTO.
The symbol (often seen in superscript like this: ) is used to provide notice to the public that a trademark or service mark is registered. In most jurisdictions, the may be used only after registration of the mark is granted.
