In the United States, a design patent is a form of legal protection granted to the ornamental design of an article of manufacture. Design patents are a type of industrial design right. Ornamental designs of jewelry, furniture, beverage containers (Fig.
Design patents legally protect what an invention or creative work looks like, its shape and configuration, and any specific ornamentation or coloration (35 U.S.C. 171). Compared with utility patents, design patents protect the form of a product.
For a successful design patent enforcement action under current law, the patent owner must show that an ordinary observer likely would confuse the accused device with the patented design. The ordinary observer is the usual purchaser of the accused device from the accused infringer.
Some examples of design patents include ornamental designs on jewelry, automobiles or furniture, as well as packaging, fonts, and computer icons (such as emojis). Some famous design patent objects include the original curvy Coca-Cola bottle (1915) and the Statue of Liberty (1879).
The five primary requirements for patentability are: (1) patentable subject matter, (2) utility, (3) novelty, (4) nonobviousness, and (5) enablement.
The first part of section 171 imposes four requirements for design patentability: novelty, originality, ornamentality, and the subject matter must be an article of manufacture.
Ornamental means that the design is purely decorative; the patentability is based on its visual aspects. Those aspects are the shape or configuration of an article (like the shape of a bottle or a vase), the surface ornamentation on the article (like a painting on the bottle or vase), or a combination of both.
