Hi, Tim Blankenship here with divorce661.com. In this episode, were talking about California child custody agreements and parenting plans. Basically, what you can come up with and what is required by the courts as far as a parenting plan? People have asked me whats required. Like how much detail does the court need as far as a custom plan? Heres the answer. The courts do not need a detailed parenting plan at all. All they need to know is how you are going to label your custody. Meaning, are you going to have joint legal and joint physical or is one party going to be the sole physical custodial parent etc.? You dont need an actual detail plan. For people who want to have an open parenting plan and not a specified plan, you can simply say joint legal, joint physical, and reasonable right of visitation to the other party. Thats sufficient enough for the court. Theyre not going to kick that back and say no we need a parenting plan. If you want an open schedule for people that maybe h

Access is a right of the child and not a right of the parent. A parent with custody cannot refuse access to the other parent, unless there is a Court order stating that. If a parent with custody refuses access, he or she can be found in contempt of Court, fined or possibly imprisoned.
Close to 80 percent of children under the age of 12 were placed in their mothers custody in cases where a court order existed. Almost 7 percent were placed in their fathers custody, and for 13 percent of children, a shared custody arrangement was established.
Generally, an unmarried parent who has the care and control of the child is considered the sole custodian without having to go to court. This is usually the mother of the child. A court may order otherwise if there is a child custody case to be heard.
Factors that will determine the percentage of shared custody each parent has include: The number of hours the child spends with the parent. The number of days the child spends with the parent. If the parent can add the number of hours the child spends in school or activities as part of their parenting time.
Filing for Child Custody in California: 5 Simple Steps Step 1: Open a case. Step 2: Complete your custody forms. Step 3: File with the court. Step 4: Serve the other parent. Step 5: File the remaining forms. Additional help with your initial filing. Preparing for what comes next.
The general parts of a parenting agreement are: A parenting time schedule. Information about how the parents will make decisions for the child. Information about finances and expenses. Parenting provisions (rules about raising the child) Any other information you want to include.
Judges look at which parent can best provide the basic necessities of life, and also provide education and guidance for the child. When a child has special needs and one parent can provide for those special needs better than the other, that is another important factor that the judge takes into account.
Under Ontarios Childrens Law Reform Act, the default regime is that both parents are equally entitled to seek custody (s. 21). A parent will be awarded custody if it is deemed to be in the best interests of the child.
