Security (damage) deposit Landlords usually ask tenants for a security deposit, sometimes called a damage deposit. The amount of a security deposit cannot be more than one months rent at the time tenancy starts. The security deposit cannot be increased as rent increases, or for any other reason during the tenancy.
If return conditions are not met If the tenant does not meet the conditions, the landlord has the right to keep part or all of the security deposit to cover costs. If the costs exceed the security deposit, the landlord can take legal action to claim for the money owing.
Individuals must provide proof of need, for example: In the case of emergency damage deposit or eviction benefits a statement of arrears or notice of eviction must be provided. In the case of utility arrears a utility bill or statement must be provided.
It is defined as the deterioration that occurs over time with the use of the premises even though the premises receive reasonable care and maintenance. Normal wear and tear is assessed based on the duration of the tenancy, and could include scuffs on the floors and walls, and nail holes from hanging pictures.
The landlord can use the money from your security deposit when you move out, but only for certain reasons. Here are some examples: the tenant still owes money for rent. the tenant caused damage to the property and the landlord completed inspection reports.
The LTB does not cover issues between a landlord and a tenant before a lease begins. However, if a landlord and tenant sign a lease and the landlord collects a rent deposit from a tenant but then does not allow the tenant to move in, the landlord must return the tenants rent deposit.
Include the date and rental period of the payment, the property address, the tenants full name, and the person receiving the payment. Include the payment amount, the method of payment, the remaining lease balance (if applicable), and any other information that may be important, like late fees.
Security deposits, legal or not in Ontario? No, security deposits (damage deposits as theyre also known) are illegal in Ontario. If a tenant damages something and you want them to pay to replace or fix it, you must ask them for money that is separate from their rental deposit.
