It is an exception to the general rule that the person who actually creates a work is the legally-recognized author of that work. In the United States and certain other copyright jurisdictions, if a work is made for hire, the employer, not the employee, is considered the legal author.
There are two situations in which a work made for hire is produced: (1) when the work is created by an employee as part of the employees regular duties and (2) when a certain type of work is created as a result of an express written agreement between the creator and a party specially ordering or commissioning the work
A work for hire agreement is a written contract between an employer and an independent contractor (or contracted team or employee) to complete services in exchange for money. The agreement should outline the expectations and scope of the project.
A work for hire, or work made for hire, refers to works whose ownership belongs to a third party rather than the creator. Under general copyright principals, a copyright becomes the property of the author who created the work.
Work made for hire is a concept in American copyright law that applies to works made under a contract of employment and works made by an independent contractor where the work is commissioned under an agreement that explicitly states that the work is work made for hire.
In order for a contractors work to be considered a work made for hire, it must satisfy several conditions: (1) it must be specially ordered or commissioned by the business; (2) must fit into one of nine enumerated categories identified in the Copyright Law; and (3) must be produced pursuant to a written agreement
In order for a contractors work to be considered a work made for hire, it must satisfy several conditions: (1) it must be specially ordered or commissioned by the business; (2) must fit into one of nine enumerated categories identified in the Copyright Law; and (3) must be produced pursuant to a written agreement
The works made for hire doctrine applies when: (1) the creator is an employee who created the work within the scope of his employment, or (2) he is an independent contractor and the client specifically commissioned his work for a project.
Works made for hire are an exception to this rule. 1 For legal purposes, when a work is a work made for hire, the author is not the individual who actually created the work. Instead, the party that hired the individual is considered both the author and the copyright owner of the work.
The nine categories listed in part 2 of the definition include: 1) a collective work; 2) a part of a motion pic- ture or other audiovisual work; 3) a translation; 4) a supplementary work; 5) a compilation; 6) an instruc- tional text; 7) a test; 8) answer material for a test; or 9) an atlas.
