Steve Tracy, an attorney with over 20 years of experience, explains the differences between an affidavit of airship and probate. Governments aim to determine the intent of individuals who pass away without a will, typically assuming that family members will inherit their property. The affidavit of airship is a straightforward document used in certain states that declares an individual as an heir to the deceased's estate, allowing them to inherit property without undergoing probate. This form is intended for situations where the estate's value is not significant. In contrast, probate is a court process that legally transfers property ownership.

Because an affidavit of heirship does not affect the rights of an omitted heir or any creditors of the decedent, they can challenge any ownership claim and claim an interest in the property owned by the decedent at any time.
When do you use an affidavit of heirship? An affidavit of heirship can be used when someone dies without a will, and the estate consists mostly of real property titled in the deceaseds name. It is an affidavit used to identify the heirs to real property when the deceased died without a will (that is, intestate).
A loved one or heir of the decedent must file an affidavit of heirship with the county clerk of the counties in which the decedent owned property or resided at the time of death.
Once the affidavit has been recorded, the heirs are identified in the property records as the new owners of the property. Thereafter, the heir or heirs may transfer or sell the property if they choose to do so. At that point, the deed most commonly used to transfer the property is a General Warranty Deed.
An affidavit of heirship must be signed and sworn to before a notary public by a person who knew the decedent and the decedents family history. This person can be a friend of the decedent, an old friend of the family, or a neighbor, for example.

An affidavit of heirship should be signed by two disinterested witnesses. To qualify as a disinterested witness, one must be knowledgeable about the deceased and his or her family history, but cannot benefit financially from the estate.
The nominal price of an Affidavit of Heirship is $500. It consists of the attorneys fees to prepare the document and the cost to record the real property records. However, this cost depends from attorney to attorney.
