Additional Terms Require the landlord to make changes to the unit before the tenant moves in, and Provide rules for use of common spaces and/or amenities. These additional terms should be written in plain language and clearly set out what the landlord or tenant must or must not do to comply with the term.
In Ontario, landlords are required to offer the standard lease for most residential tenancies, including single and semi-detached houses, apartment buildings, rented condominiums, and secondary units like basement apartments.
A written tenancy agreement is important as it defines the responsibilities of parties and allows the landlord to reserve certain rights. The standard lease developed by the Ministry of Housing will apply to most residential tenancies in Ontario, including: single and semi-detached houses.
However, a lease can be for any length of time, as long as both parties agree. It can be for 1 week, 4 months, 9 months, 3 years theres no minimum or maximum time period.
A lease can be in writing or it can be a spoken (verbal) agreement. A lease may also be called a tenancy agreement or a rental contract. Ontario has a Standard Form of Lease for residential properties. The standard form of lease lists things like: Names and contact information of the tenant and the landlord.
In a fixed-term tenancy, the landlord and tenant agree that the tenancy will last for a specific period of time and the agreement includes the start and end date. This means that the landlords and the tenants rights and obligations are fixed for the term of the tenancy.
Also known as Amendment to Agreement to Lease Residential, OREA Form 405 is a document in Ontarios real estate used to modify or update existing terms. It records changes agreed upon by both parties and guarantees a clear and official alteration to the original leasing agreement.
The Ontario government introduced a mandatory standard lease template in 2018 to simplify the rental process, ensure clarity, and protect the rights of both landlords and tenants.
