Fair Lending Laws/Regulations Equal Credit Opportunity Act (ECOA) This law affects every phase of the lending process and prohibits discrimination on the basis of: Fair Housing Act (FHA) Americans With Disabilities Act (ADA) Civil Rights Act of 1866. Home Mortgage Disclosure Act (HMDA)
Disparate Impact For example, a lender may have a policy of not making single family home loans for less than $60,000. This policy might exclude a high number of applicants who have lower income levels or lower home values than the rest of the applicant pool. That uneven effect of the policy is called disparate impact.
For example, if a lender refuses to make a mortgage loan because of your race or ethnicity, or if a lender charges excessive fees to refinance your current mortgage loan based on your race or ethnicity, the lender is in violation of the federal Fair Housing Act.
There are three types of lending discrimination: Overt. Disparate impact. Disparate treatment. Speak with your lenders manager. File a complaint with the Consumer Financial Protection Bureau (CFPB). File a complaint with the U.S. Office of Fair Housing and Equal Opportunity (FHEO).
Disparate treatment occurs when a lender treats a credit applicant differently based on one of the prohibited bases. It does not require any showing that the treatment was motivated by prejudice or a conscious intention to discriminate against a person beyond the difference in treatment itself.
Discouraged from applying for credit. Encouraged or told to apply for a type of loan that has less favorable terms (for example, a higher interest rate) Hearing the lender making negative comments about race, national origin, age, sex (including sexual orientation or gender identity), or other protected statuses.
