deed of assumption (plural deeds of assumption) (law, Scotland) A deed executed by trustees under a trust-deed assuming a new trustee or settlement.
As the title indicates, in a deed of trust to secure assumption, another person assumes the note already in place, guaranteeing payment to the grantor in the deed. The agreement means that the buyer or grantee in the deed takes the property, assuming the debt currently on the property.
If you loan someone money and want to secure the promise to repay the borrowed money with real estate, you will need a Deed of Trust. To secure the loan, the Borrower, the person that owes you the money, signs a Deed of Trust to give you, the Lender, a lien on real estate.
A flexible trust allows you, the Proposer, to retain some control and decide who should benefit from your assets. In this type of trust you, the Proposer, are also a trustee. OneFamilys Flexible Trust deed is a split trust.
An assumption deed is used when another person assumes the note of a deed of trust already in place. The assumption deed or assumption deed of trust is executed when the owner of real estate burdened by a deed of trust sells, and the buyer agrees to assume the debt and make payments under the deed of trust.
An assumption transaction may be accomplished with or without consent of the lender. The transaction involves only a title transfer (a conveyance by deed in which the lender does not participate) and a promise by the buyer to take over payments on an existing debt.
