Black out days are used to restrict Time Off Requests from being submitted by employees. Black Out Days are entity specific. A list of records can be defined for date ranges or days of the week by job or schedule group for which time off requests will be restricted.
In general, yes, employers may require the use of vacation/paid time off (PTO) and restrict its use. When there are no legal requirements, such as state and local paid leave laws, restrictions on when and the increments in which PTO may be used, are common.
While it may seem hard to believe, yes, it is technically possible to be fired for using up all your sick and vacation leave. However, its important to note that such a decision typically depends on the companys policies and the specific circumstances surrounding your absence.
While legally, employers can deny vacation requests, compliance with laws like the Family Medical Leave Act (FMLA) is non-negotiable.
A PTO blackout is a date or period in which employees may not take time off work. HR or an employer may enforce this to avoid being inundated with PTO requests during particularly busy times such as the end of a quarter or around the holidays. Currently, theres no federal law that regulates PTO blackouts.
It is important to realize that, where paid time off is concerned, an employer can deny a time off request. The only circumstances where an unpaid time off request cannot be denied are in cases protected under the Family and Medical Leave Act and the California Family Rights Act.
So, always double-check your employment contract. However, you should generally be able to use PTO whenever you want, given that you got approval from your supervisor. Your days off may not be approved if that period is particularly busy or another coworker is off work at the same time.
Some employers may engage in practices such as requiring employees to give several weeks notice before taking a vacation day or may institute blackout days when employees cannot request vacation time. This would be legal because California does not place too many limits on employers vacation policies.
