Once judgment is passed in favor of the landlord, the tenant must move out within 10 days. The appropriate law enforcement official must be given the Writ within 7 days from the day it is issued. There is no specific length of time for them to execute the Writ and forcefully evict the tenant.
Once rent is past due, the landlord must provide tenants with a "7-Day Notice to Pay" if the landlord wants to file an eviction action with the court. This notice gives the tenant the option to pay the past due amount in full within seven days (or move out) in order to avoid eviction.
The appropriate Eviction Notice to serve for non-payment of rent would be a 3 Day Notice to Pay or Quit, or a 30 or 60 Day Notice to Vacate. If the tenant has been there for less than a year paying on a month to month basis and you want to terminate their tenancy, a 30 Day Notice to Vacate is the correct form to serve.
If the reason the landlord wants to evict the tenant is due to nonpayment of rent, then the legal notice the landlord must serve on the tenant is called a 7-day Demand for Nonpayment of Rent. You should say something like: “I am giving 1 month's notice to end my tenancy, as required by law. I will be leaving the property on (date xx). I would like you to be at the property on the day I move out to check the premises and for me to return the keys.
