Yes. California law requires that any time you agree to construction work that will cost more than $500, there must be a written contract between you and the contractor.
In California, a written contract is required for all home improvement projects over $500. A home improvement contract and any changes made to that contract must be in writing, legible, easy to understand, and inform the consumer of their rights to cancel or rescind the contract.
For a contract to be valid and enforceable in California, all parties must enter into the agreement voluntarily. If one of the contracting parties can prove that they entered into the contract under duress, coercion, or undue influence, the court may cancel or revoke the contract.
A contract should contain everything agreed upon by you and your licensed contractor. It should detail the work, price, when payments will be made, who gets the necessary building permits, and when the job will be finished. The contract also must identify the contractor, and give their address and license number.
Civil Code 3260.1. Except as otherwise agreed in writing, the owner shall pay to the contractor, within 30 days following receipt of a demand for payment in ance with the contract, any progress payment due thereunder as to which there is no good faith dispute between the parties.
The contract should describe, in detail, the products to be used and how the work will be performed, i.e., size, color, who will be doing what work, amounts of materials provided, manufacturer model number, etc. There must be a detailed, written payment schedule in the contract.
Cost-Plus Contract Cost-plus contracts also include provisions where owners agree to pay a percentage that covers the builders overhead and profit. . However, California law prohibits any contracts for improvement of a residence to be cost-plus contracts.
