good afternoon for todays two minute tuesday i wanted to talk a little bit about red flags and contracts of course contracts can get very complicated and i usually recommend to people that they have an attorney review anything before they sign it however i understand that thats not always possible and so today id like to discuss again some of those red flags that i look for when im reviewing a contract the first one that i look for and this may be the most important is something thats required of my con my client thats not required of the other side this comes up very frequently in settlement agreements in which for example my client agrees to pay money or agrees to accept money and theres what they call a non-disclosure agreement which prohibits my client from saying anything about the settlement well if my client cant talk about the settlement i want to make sure that the other side also cant talk about the settlement if my client has to pay legal fees to enforce the settlem

In California, a severance agreement is a legally binding document, serving as a contract between an employer and employee, offering additional compensation or benefits that go beyond the scope of what the employee may typically be entitled to under the law.
There is no requirement in the Fair Labor Standards Act (FLSA) for severance pay. Severance pay is a matter of agreement between an employer and an employee (or the employees representative).
In general, severance agreements are legally valid and will be upheld by courts, as long as the agreement was entered into voluntarily and the terms are legal. 4 This is true even if it seems that the employer is getting the better deal.
When NOT to sign a severance agreement 5 Examples you intend to sue your employer after your termination, the severance package is not sufficient, you do not have legal representation, it would unduly restrict your professional future, and. you do not fully understand the agreement.
These include financial drawbacks such as loss of steady income and potential loss of benefits, as well as the uncertainty of future job prospects and impact on retirement savings and benefits.
Violation of employment laws Severance agreements must comply with relevant employment laws such as anti-discrimination laws, wage and hour regulations and workers compensation provisions. An agreement containing provisions that contradict these laws may be considered invalid.
