Unlike other provinces such as B.C. and Ontario, Quebec does not set a hard cap on rent increases. Instead, the provinces rental board, the Tribunal administratif du logement (TAL) provides landlords with a recommendation based on landlords typical expenses for similar properties.
Whatever the notice looks like, a tenant who wants to refuse the rent increase should send a letter to the landlord saying so, within one month of receiving the landlords notice.
If the tenant does not accept the renewal offer within the prescribed time, the landlord may refuse to renew the lease and seek to evict the tenant through court proceedings. If the tenant accepts the renewal offer, the landlord has 30 days to return the fully executed lease to the tenant.
You can end the lease by giving your landlord a months notice. However, the landlord can also end the lease by giving you a months notice. If this happens unexpectedly, you may need to find a new home quickly. The lease can end at any time, so long as the party who wants to end the lease gives a months notice.
In California, landlords can refuse to renew a lease if they provide written notice to the tenant at least 60 days before the lease termination date.
In response to your notice of rent increase and modification of another condition of the lease, I hereby inform you that (check off ONE of the boxes below): I accept the renewal of the lease with the modifications. I refuse the proposed modifications and am renewing the lease.
Here is an example of a letter to respond to a rent increase: Dear [Landlords Name], I am writing this letter to confirm my agreement of the rent increase from [current rent amount] to [new rent amount] as of [date of rent increase]. I understand the need for this increase and agree to pay the new amount.
Refuse the increase and stay in your dwelling. In this case, your owner can negotiate with you or ask the Tribunal administratif du logement (TAL) to set the rent. Your landlord has one month to complete this process. The current rent will be maintained until the Tribunal renders its decision.
