No, you do not need permission from the trademark owner to use the trademark symbol (). The trademark symbol is a generic symbol used to indicate that you consider a particular word, phrase, logo, or other mark to be a trademark and that you claim rights over it.
Anyone can use a TM symbol regardless of whether theyve successfully registered the trademark, or whether theyve applied for a trademark at all. Even if the trademark application is rejected, the owner can continue to use the TM symbol.
