absolutely we strongly recommend that a trademark search be conducted in fact I would say that a trademark search is probably the more important part of the process than the trademark application or registration because in the U.S P you can acquire rights in a mark just from the use of the Market Commerce even without a registration but you want to make sure that you are not starting to use a Mark that is already being used by somebody and somewhere down the line theyamp;#39;re going to come back at you and say youamp;#39;ve got to stop using it and sometimes you donamp;#39;t know how long or when that is going to be and itamp;#39;s like a ticking Time Bomb so itamp;#39;s probably more important I would say to just clear the mark make sure you have available rights that are youamp;#39;re acquiring and then you know if you need to apply later for the registration and apply later when uh when thereamp;#39;s more funds in the business

Yes, you can create funny videos using short gifs from Giphy, add your own voiceover, and upload it to YouTube. However, it is important to ensure that you have the proper rights to use the gifs in your video, and that the content of the video does not violate YouTubes community guidelines or terms of service.

Understanding Copyright Law While GIFs can be considered artistic works in their own right, this also includes GIPHY art, which frequently features the work of artists who have developed their own unique animations or other forms of visual media specifically for the GIPHY platform.
The rules of copyright dont change just because its animated GIFs were talking about. So if you use someone elses copyrighted work without permission, then youre infringing their copyright, unless you can show that your use is considered fair use.
You can also change the visibility of content to be Public or Private. Private content cannot be seen by anyone but you when you are logged in, and they cant be shared. Settings will be applied to all the media in your upload.
As such, the content within a GIF is usually protected by copyright owned by the original creator, making it difficult to claim exclusive rights to a GIF as a trademark.
