It is much easier to prove abandonment if there has been three years of nonuse, so that the presumption attaches. If there isnt three years of consecutive nonuse, then the burden remains with the party bringing the claim to show nonuse and lack of intent to resume use by a preponderance of evidence.
Evidence of non-use of the mark for three consecutive years is prima facie evidence of abandonment.
Three consecutive years of nonuse establishes a rebuttable showing of abandonment. The registrant then has the burden of producing the rebuttal evidence, although the party attempting to prove abandonment continues to have the burden of persuasion by a preponderance of the evidence.
The trademark statute (Section 45, 15 U.S.C, 1127) defines Abandonment in part as: When its use has been discontinued with intent not to resume such use. Nonuse for 3 consecutive years shall be prima facie evidence of abandonment.

Trademarks are not required but are a way to notify the public of the use of a certain name (Doing Business As) or design (logo) that you are using in Wisconsin.
Trademark process Step 1: Is a trademark application right for you? Step 2: Get ready to apply. Step 3: Prepare and submit your application. Step 4: Work with the assigned USPTO examining attorney. Step 5: Receive approval/denial of your application. Step 6: Maintain your registration.
If your trademark application isnt the subject of an appeal, an opposition, or a concurrent use proceeding, then you should complete and submit the Request for Express Abandonment of Application form thats available on the USPTO website.
