Is it possible to register a trademark in one class at first, and then register another class(es) later? Yes, it is possible to register a trademark in another class later; however, bear in mind that this would need to be a new application for a new trademark. You cant extend classes on a previously filed trademark.
For example, a specimen could be an advertisement, brochure, website printout or other promotional material which shows your trademark used for the services, business signs where the services are rendered showing your trademark, or a service vehicle showing your trademark.
Once a trademark application is filed, you may no longer add additional classes to it. If you need to protect your trademarks for new product or service offerings, you must file a another, separate application.
The Trademark Act provides for a system of trademark classes to categorize goods and services. Classes 1-34 cover goods, while classes 35-45 cover services. The use of the same trademark is permissible across different classes, as long as there is no likelihood of confusion among consumers.
The number of classes you need depends on what goods and services you sell under your brand. There are 45 different standardized classes you have to choose from. Classes 1-34 cover goods, and classes 35-45 cover services. If you sell a wider variety of products and services, you can choose multiple classes.
The United States Patent and Trademark Office (USPTO) allows trademark applicants to include several goods and/or services spanning multiple classes on a single trademark application submission.
You can apply to register your trademark as a standard character trademark or a special form trademark.
In certain cases, it might be more efficient to file a single application containing more than one class. By filing a single multi-class trademark application, you have fewer deadlines to docket. There will be only one foreign filing deadline.
