I want to share the latest information from the USPTO about the delays in processing trademark filings you can see this page here published by the USPTO on their website and as of March 2023 initial applications are taking on average eight and a half months before they get reviewed by an examining attorney and weamp;#39;re actually seeing the vast majority take more like nine and a half months another data point here that is very important is that renewal filings uh are taking some of them up to half a year to get reviewed by the U.S patent and trademark office and this is Way Way Beyond the target date that they have sent I note also that while the USPTO is just barely meeting its Targets on applications they have extended those targets numerous times over the last two years

Got questions?

Below are some common questions from our customers that may provide you with the answer you're looking for. If you can't find an answer to your question, please don't hesitate to reach out to us.

To apply, use the Trademark Electronic Application System (TEAS) to complete the initial application. The initial application form has two filing options: TEAS Plus and TEAS Standard. Costs differ between filing options because the filing options have a different number of up-front requirements.
You can use TM for goods or SM for services even if you havent filed an application to register your trademark. Once you register your trademark with us, use an with the trademark.
To respond to a final office action, use the TEAS Request for Reconsideration after Final Action form. NOTE: If you need to respond to an office action, and you cannot resolve all outstanding issues by phone or email, you must file your response to the office action through TEAS.
State trademark registration only protects your trademark in the state where you register it. Registering a trademark with the state is less expensive than registering with the USPTO. You will typically save at least $200 for each registration.
As long as your trademarks distinctiveness identifies your product and services, you may claim trademark rights for your unregistered trademark and stop otherseven bigger companiesfrom using your mark, but only in your geographic area. Unregistered trademarks may be protected by federal trademark laws.
Not registering a trademark comes with legal and financial risks. A competitor can register your trademark for their business and take it from you. You will be forced to rebrand. You will have limited trademark rights at best.
How you choose to protect your trademark is up to you. You are not required to register your trademark, but where or whether you decide to register your trademark can determine the scope of your rights. Specifically, you can rely on common law rights or file for state, federal, or international trademark registration.
Trademark process Step 1: Is a trademark application right for you? Step 2: Get ready to apply. Step 3: Prepare and submit your application. Step 4: Work with the assigned USPTO examining attorney. Step 5: Receive approval/denial of your application. Step 6: Maintain your registration.
