The Virginia Residential Landlord and Tenant Act governs the relations between landlords and tenants. A landlord must file an eviction lawsuit, also called an unlawful detainer suit, and receive a court order before physically evicting a tenant.

Whenever a landlord or a tenant wish to end such an arrangement, he or she must do so legally by issuing a notice of such intent, to be received, at least sixty (60) days before the desired date for termination.
A minimum of 60 full days notice is required. In some circumstances the tenant/s may apply to the court for a 60 day extension of the period of notice (option 5).
Under HB 1236, a landlord may no longer terminate a month-to-month tenancy (or other periodic tenancy) without cause. A landlord can now only terminate a month-to-month or periodic tenancy if one of over a dozen causes applies. The complete list can be found in Section 2 of HB 1236.
When a property owner decides to evict a tenant, the landlord must provide the tenant with a Three-Day Notice to Pay or Quit or a Three-Day Notice to Cure or Quit, depending upon whether the landlord wants the tenant to pay rent or to cure a bdocHub of the contract.
