A parenting plan is a written record of an agreement between the parents about the care of the children that is also signed and dated. However, it is not a legally enforceable agreement. There is no required format for a parenting plan.
In New Hampshire, the court does consider the childs reasonable wishes when determining which parent wins custody. The judge may take the childs age, maturity, and judgement into consideration when considering the childs custody preference.
Under the law, both parents are assumed to be equally entitled to parenting time, regardless of gender.
In New Hampshire, courts must consider a list of factors when evaluating best interests, including: the childs relationship with each parent, and the parents ability to provide nurture, love, affection, and guidance.
The law doesnt specify an age at which the court must take into consideration a childs preference. Thats because age doesnt determine maturity level. So its conceivable that a judge might take into account the wishes of a young, mature child, but not those of an older, less responsible one.
California parenting plans must contain information about physical and legal custody. Physical custody is where your child lives and who cares for them. You should specify whether one parent will have sole physical custody or the parents will share joint physical custody.
In New Hampshire, more and more parents share joint residential responsibility for children, sharing equally in the parenting time. Many people may assume that if parents share equally in the time with the children, then they will have equal expenses and therefore neither party would pay child support to the other.
The legal definition of an unfit parent is when the parent through their conduct fails to provide proper guidance, care, or support. Also, if there is abuse, neglect, or substance abuse issues, that parent will be deemed unfit.
