You may submit a work for preregistration only if it meets these three conditions: the work must be unpublished. the work must be in the process of being prepared for commercial distribution in either physical or digital format, e.g., film copies, CDs, or computer programs to be sold online.
Registering a claim to copyright via eCO involves three steps in the following order: Complete an application. Pay the associated fee (Pay online with a credit/debit card or ACH transfer via Pay.gov, or with a deposit account) Submit your work.
In general, the permissions process involves a simple five-step procedure: Determine if permission is needed. Identify the owner. Identify the rights needed. Contact the owner and negotiate whether payment is required. Get your permission agreement in writing.
You do not have to receive your certificate of registration before you publish or produce your work. Nor do you need permission from the Copyright Office to place a copyright notice on your work.
For many publications, the publisher is the owner of the copyright and can grant permission for your use. Some publishers have online copyright permission pages that simplify the process. If the publisher is not the copyright owner, a publisher representative can often direct you to the copyright owner.
To register a claim to copyright with the U.S. Copyright Office, the claimant must: (1) submit a properly completed application; (2) pay a nonrefundable fee; and (3) deposit the required number of copies of the works to be registered.
