There are two situations where an employer will be legally required to respond to requests for a verification of employment: When they receive a federally backed request, such as a request from a federal loan institution, to verify an individuals employment.
Generally, you are not legally responsible to answer an employee verification request unless it is issued by a federal group. However, most employers do answer these requests as often as possible, even when not legally required. The most important thing is to only give the information you can legally give.
An employment verification will usually verify a candidates title, employment dates (start and end), and occasionally salary history and job duties. Salary related questions are becoming less frequent as local laws are prohibiting those types of questions.
Employers are not required by law to respond to these requests, but most choose to. Some employers require that employees give permission to respond to these requests. Generally, employers do not face any legal issues if they respond truthfully and in good faith.
An employment verification letter should include: Your company name, address, and contact information. Employee name. Dates of employment. Job title (or positions held) Job description. Reason for termination (if applicable) Current salary (if requested and if state laws allow)
The U.S. Department of Labor (DOL) utilizes an automated employment verification service, allowing current and former DOL employees to have employment and salary information easily verified by third parties.
