How to Assemble Pour-Over Will

Attorney Andrew Bethel discusses the importance of a pour-over will in relation to a living trust. A pour-over will works alongside a living trust by transferring non-trust assets into the trust upon death. It is likened to a teacup (the trust) and a saucer (the pour-over will); the saucer collects any assets that didn't make it into the trust, preventing them from falling into probate. This will serves as a safety net for assets, ensuring they are directed to the trust instead of being subjected to probate. Understanding the functionality of a pour-over will is essential for effective estate planning.

Not necessarily. Assets in a pour-over will only avoid probate if their total value is under $184,500, thereby qualifying the estate for a small estate affidavit. If the assets total more than $184,500, then they will have to go through probate.

It is necessary to probate a Will when the estate includes assets titled in the decedents name. The Texas Estates Code specifically says that Will is not effective to prove title to or the right to possession of any property disposed of by the Will until the Will is admitted to probate.
Under Texas law, individuals (testators) may create a revocable living trust which allows them to use their assets during their lifetime and subsequently securely transfer them to their designated beneficiaries after the testators death.
Does a Pour-Over Will Avoid Probate? Just like any other type of will, a pour-over will must be signed by yourself and two witnesses in order to be considered valid in Arizona. However, it must still go through probate and be validated by the court before your assets can be distributed to the living trust.
With a pour-over will, any assets not included in your trust are automatically transferred to your trust after you pass away. Think of it as a kind of safety net, capturing any property you didnt transfer to your trust while you were alive.
Probate of Will/Appointment of Independent Executor Proceeding Application for Probate of Will and Issuance of Letters Testamentary (in WordPerfect format) Proof of Death and Other Facts (Probate Proceeding) (in WordPerfect format)
A pour-over will only goes through probate if you have failed to attach all your assets to your living trust. The probate process with a pour-over will is much shorter than probate with a traditional will.
