What is a Business Associate Agreement? For vendors that create, receive, maintain, or transmit PHI on your organizations behalf (called business associates) you must have a business associate agreement. The BAA contract is unique to HIPAA.
HIPAA applies to healthcare providers, health plans and healthcare clearinghouses who transmit data electronically. So basically, every provider, such as your doctor, dentist, pharmacy, hospital, etc. would need to be compliant.
