Tennessee law does not recognize transfer-on-death (TOD) deeds. In states that authorize them, TOD deeds allow real estate to automatically transfer to a named beneficiary upon the current owners death. The advantage of TOD deeds is that they do not limit the owners property rights during life.
Indiana allows you to leave real estate with transfer-on-death deeds, also called beneficiary deeds. You sign and record the deed now, but it doesnt take effect until your death. You can revoke the deed or sell the property at any time; the beneficiary you name on the deed has no rights until your death.
Cons To Using Beneficiary Deed Estate taxes. Property transferred may be taxed. No asset protection. The beneficiary receives the property without protection from creditors, divorces, and lawsuits. Medicaid eligibility. No automatic transfer. Incapacity not addressed. Problems with beneficiaries.
Paying for a TOD deed could be a complete waste of money. TOD deeds put private estate planning in the public eye. TOD deeds dont completely avoid probate. For most folks, TOD deeds dont offer docHub tax benefits. TOD deeds can complicate future estate planning.
Adding a TOD Beneficiary A TOD Beneficiary may be added to an Indiana Certificate of Title at the time of purchase (title transfer), or, if you already have title to the vehicle, you may apply for new title containing the TOD designation.
