A promissory note basically includes the name of both parties (lender and borrower), date of the loan, the amount, the date the loan will be repaid in full, frequency of loan payments, the interest rate charged on the loan payments, and any security agreement.
At its most basic, a promissory note should include the following things: Date. Name of the lender and borrower. Loan amount. Whether the loan is secured or unsecured. If its secured with collateral: What is the collateral? Payment amount and frequency. Payment due date. Whether the loan has a cosigner, and if so, who.
If the promissory note is unconditional and readily salable, it is called a negotiable instrument. The terms of a note usually include the principal amount, the interest rate (if any), the parties, date, terms of repayment (which could include interest) and the maturity date.
A simple promissory note might be for a lump sum repayment on a certain date. For example, you lend your friend $1,000 and he agrees to repay you by December 1. The full amount is due on that date, and there is no payment schedule involved.
The parts of a promissory note are: Lender details and contact information. Borrower name and contact information. Interest rate and how its been calculated. Principal loan amount. Loan maturity date. The date of the first payment is required. Fees and charges. Date and place of issuance.
A promissory note must include the date of the loan, the dollar amount, the names of both parties, the rate of interest, any collateral involved, and the timeline for repayment. When this document is signed by the borrower, it becomes a legally binding contract.
Some common triggers that can invalidate and cause problems in a promissory note are: missing the payment schedule or interest rate, loss of the original copy of the document, and others. When a promissory note becomes invalid the lender cannot sue the borrower legally if they fail to make payments.
You can use a template or create a promissory note online. But before you begin, youll need to gather some information and make decisions about the way the loan will be structured. First, youll need the names and addresses of both the lender (or payee) and the borrower.
