In this episode of Minute Law, Maria Spear Ollis discusses waiver clauses in contracts as part of the "What's in My Contract" series. She explains that a typical waiver clause states that waiving a right regarding one aspect of the contract does not mean you waive that right for future instances. Using a hypothetical example, she illustrates that if a client usually pays on time but fails to do so one month, and the service provider chooses not to enforce a late fee, this does not set a precedent for future late payments. The waiver clause protects the provider's ability to enforce the late fee in subsequent months, despite the prior waiver of that right.
