The proposal grants workers 40 hours of paid sick leave if they contract COVID, plus an additional 40 hours to care for a family member with COVID. This sick leave is retroactive to January 1, 2022, but there will be no coverage for October to December of 2021 due to a gap between programs. Employees of companies with over 25 workers are eligible, including part-time workers; however, part-time eligibility is determined based on hours worked. Independent contractors are excluded, as the proposal only covers employees. Additionally, concerns have arisen regarding the coverage of undocumented Californians, with reports of employers misleading immigrant workers.

The new 2022 COVID-19 Supplemental Paid Sick Leave law allows covered employees to take up to 40 hours of COVID-19 related sick leave during the period January 1, 2022 to December 31, 2022, regardless of whether they took leave under the previous laws.
Federal and State Laws Therefore, employers cant change their vacation policies in a way that would take vacation time away from an employee who has already earned it. They also cant have so-called use it or lose it policies, in which employees forfeit unused vacation time after a certain date.
The employer must provide at least 24 hours or three days of paid sick leave per year and the full amount of this leave must be available for the employees use from the beginning of each year of employment, calendar year, or 12-month period.

Californias PSL law requires employers to provide at least 24 hours or three days off work for employees who work for the same employer for at least 30 days and complete 90 days of employment before taking any paid sick leave.
So, if youre an at-will employee and your boss decides youve called in sick too much, they have every right to fire youand they also dont have to tell you that your illness (or excessive absences because of that illness) had anything to do with it.
In general terms, the law requires employers to provide and allow employees to use at least 24 hours or three days of paid sick leave per year. Employers adopting new policies to comply with the law may choose whether to have an accrual policy or a no accrual/up front policy.
