During a lease term, both the landlord and tenant can propose amendments, provided theyre familiar with any rules in the Lease Agreement about changing the lease. Once both parties have agreed to the changes, they can be formalized with a Lease Amendment.
Both parties must agree to the proposed amendments. A lease is a legally binding agreement between a tenant and landlord, therefore it cannot be altered without both parties consent. Typically, a landlord is more likely than a tenant to propose an amendment to the lease.
Leases are contracts and cannot be changed without the other side agreeing. The only change a landlord can make to a tenancy agreement without the tenants consent is an increase the rent. A landlord must, however, follow the rules set out in the Residential Tenancies Act for rent increases.
Who Can Amend the Lease? When a landlord and tenant sign a lease agreement it forms a legally binding contract. The lease cannot be altered except through another written agreement signed by both parties unless the original lease specifically gives a party the power to change something on their own.
If you are a leaseholder, you cannot change the lease terms without agreeing such change with your landlord. The reason for this is that as the lease is a contract between two parties, the leaseholder and the landlord, both parties must agree to change (referred to also as variation) of the terms of the lease.
You must provide the landlord with your notice no later than 30 days after the landlord gives you the standard lease. In either case, you must provide the landlord with a written notice to terminate the tenancy at least 60 days before the last day of a rental period.
A tenancy agreement can normally only be changed if both you and your landlord agree. If you both agree, the change should be recorded in writing, either by drawing up a new written document setting out the terms of the tenancy or by amending the existing written tenancy agreement.
