A break clause is written into the commercial lease from the outset and allows a Tenant (and even a Landlord) to end a lease early by serving a notice on the other party.
Usually, the tenant can only leave at the end of a period (before the next payment of rent is due), but must give at least the amount of notice required in the lease (3 months if not contracted out).
If you are a leaseholder, you cannot change the lease terms without agreeing such change with your landlord. The reason for this is that as the lease is a contract between two parties, the leaseholder and the landlord, both parties must agree to change (referred to also as variation) of the terms of the lease.
For a monthly lease, you must provide the landlord one months written notice in advance. If the lease does not specify the lease as monthly, then in ance with the Commercial Tenancies Act, section 28, a months notice given no later than the end of the month is sufficient notice.
