In California, family courts consider pets as personal property, rather than as children or family members, which means they are treated similarly to other assets such as furniture or vehicles. As a result, family courts will generally determine pet custody based on the legal ownership of the pet.
However, when it comes to the legal aspects of separation or divorce in Ontario, pets are classified as personal property or possessions. This categorization may come as a shock to many who view their pets as akin to children.
Pet Responsibility and Care Each party agrees to provide the pet(s) with excellent food, water, and maintenance. They also agree to offer care related to training and grooming. Both parties agree to license and register the pet. The person with primary ownership would be registered as the pets owner in the papers.
How are dogs treated under the law in England and Wales? A dog is considered property and there is no specific law stating what should happen with your pet during separation or divorce.
A thorough review of the pets history including origin of ownership such as a record of adoption, a proof of purchase or registration papers in the case of a purebred. The person whose name is listed will be considered the legal owner.
Most likely an individual and their ex went together to purchase the animal. However, courts will look at whos name is actually on the receipt. Most courts see an animal as property. As such, the person who paid for the animal is the one who is entitled to keep them, though this is not always set in stone.
Vet records: If your name is listed as the owner on the dogs medical history documents, this can be considered evidence of your ownership. Kennel Club registration: If the dog is a pedigree breed registered with the Kennel Club, having your name listed as the registered owner can be proof of ownership.
Pet Custody in Small Claims Court In a situation where a Small Claims Court is involved, the District Judge has the power to determine who is the dogs sole owner and they then may direct that this person has sole possession.
Call the police and report your dog as stolen. Many pet owners are surprised to learn that the law treats your beloved dog as any other piece of personal property, like a necklace or a shovel (lawyers call this chattel). You can report a dog as stolen just like you could a flat-screen TV.
