welcome once again to latos law heres Steve lato Bob sent me a one sentence email and said Steve can you please explain a mechanics lien or a garage keeper lean and Im specifically talking about the liens that have to do with automobiles some states have got mechanics liens and they actually use that in reference to any work done uh for instance on a piece of property you bring in a plumber and he works in your house and you refuse to pay him in some states that Palmer may be able to file a lien against your property to assure that he gets paid if nothing else at least when the home gets sold so Im talking about garage keeper liens or mechanics liens on automobiles because in Michigan they are authorized by MCL 570.301 at sac and theyve been around for a long long time and believe it or not years ago I had a friend who owned a gas station and he also did mechanical work there and at one occasion somebody brought a vehicle in and asked him to do the work sign the authorization did

Mechanics Liens are a risk management tool to leverage payment from an overdue customer. A Mechanics Lien in these provinces ensures you have a secured interest in a property you have worked on- or supplied materials to a job site. Generally, liens are a collection tool in the event of non-payment.
There are several steps to bring a lien claim: Register the lien against the property at the Land Registry. Start a legal action in the Supreme Court of Nova Scotia against everyone above the contractor or supplier in the construction chain. Register the action with the Land Registry.
Mechanics liens expire unless you file a lawsuit to enforce your Lien within 90 days of when the lien was recorded. Just recording a lien does not get you paid, if you do not sue to collect on it in 90 days. This is known as perfecting your lien.
Filing a Court Claim Before you can place a lien on business property, you must first have a court order a judgment directing the debtor to pay what is owed. After filing a claim with the court and submitting proof of the amounts owed to you, the business must answer and explain why the debt is not owed.
How does a Mechanics Lien work? Provide a pre-lien notice. A pre-lien notice informs the hiring party (and any other relevant parties) of your involvement in a specific project. Provide notice of intent to lien. Create and file the lien. Notify and serve the property owner. Release the lien or seek legal action.
A Mechanics Lien is a hold placed on the title (ownership)of real estate by a contractor, material supplier, or other person who has improved the value of the property by performing work (e.g., carpentry) or supplying materials (e.g., lumber), but who has not been paid.
What date is used to establish lien priority for a mechanics lien? The date of contracting between the mechanic and the lienee. A mechanics liens priority dates from the point in time when the work commenced or ended, rather than from when it was recorded.
Going forward, Mechanics Lien (excluding the apostrophe) is the proper way to spell it.
