Generally, adding debts after a bankruptcy is filed is allowed so long as the debt existed before you filed and it is added within a certain amount of time. However, the situation can vary depending on whether you filed a Chapter 7 or a Chapter 13 bankruptcy.
Each individual employee of a bankrupt business is given a priority of up to $11,725 (as of 2010, and adjusted every three years thereafter) of the wages they earned up to 180 days before the company filed for bankruptcy. However, secured creditors are first in line, and therefore ahead of employees, for repayment.
Filing for Chapter 7 bankruptcy eliminates credit card debt, medical bills and unsecured loans; however, there are some debts that cannot be discharged. Those debts include child support, spousal support obligations, student loans, judgments for damages resulting from drunk driving accidents, and most unpaid taxes.
You should not spend any money or dispose of any assets you own when you file your Chapter 7 bankruptcy case. Without court approval, the Chapter 7 Trustee can force the recipient to return the money or property. However, the income you receive after filing your case is yours to use.
However, there are certain restrictions and limitations on what you can and cannot do after filing for Chapter 7 bankruptcy. Avoid Spending Outside Your Income Levels. You Cannot Neglect Your Alimony Child Support Obligations After Chapter 7. You Cannot Ignore Student Loans. You Cannot Eliminate Most Tax Debt.
For example, you cant discharge debts related to recent taxes, alimony, child support, and court orders. You may also not be allowed to keep certain assets, credit cards, or bank accounts, nor can you borrow money without court approval.
If you terminate the contract before bankruptcy, when the debtor files bankruptcy the contract no longer exists, and you do not have to deal with the debtor. However, if you have not terminated the contract before bankruptcy, you must obtain court permission to terminate it after bankruptcy is filed.
What does life after bankruptcy look like? Youll have to endure hardships from cash flow management to establishing good credit and rebuilding your credit profile but its possible to financially recover from bankruptcy and give yourself a fresh start.
