You can basically enter into a joint mortgage agreement with anyone, as long as they are able to qualify for a mortgage.
If your spouse is not on the mortgage, they are not responsible for paying it. However, the mortgage lender can foreclose on the house if the mortgage is not paid.
In rare cases, lenders will allow you to add additional people to a mortgage although all will have different requirements around doing so. Unfortunately approaching the existing lender route is the exception and most lenders wont allow you to add someone to the mortgage without remortgaging the property with them.
There is no law that says both spouses need to be listed on a mortgage. If your spouse isnt a co-borrower on your mortgage application, then your lender generally wont include their details when qualifying you for a loan. Depending on your spouses situation, this could be a good thing or a bad thing.
Putting your spouse on title (adding them to the ownership) is a simple process. All you need to do is have a grant deed prepared, sign it in front of a notary public, and then have it recorded. The cost is usually under $100.
The only way to change the names listed on a mortgage is to refinance in the new borrowers names. If you divorce, for example, youll need to meet the qualifications to refinance the house in your name alone. If you want to add someone to your mortgage, youll both need to jointly qualify to refinance the mortgage.
In Ontario, you must register your title in the provincial land registry. Other documents that must be registered include deeds (which transfer ownership from one person to another) and mortgage documents. When you add someone to your property title, you are giving that person an interest in your property.
Can I add my spouse to my mortgage without refinancing? It depends on the lender and the type of mortgage. Some lenders will allow you to add your spouse to your mortgage without refinancing, while others may require that you reapply for your mortgage with the new co-borrower.
Prepare the transfer deed legal documents. Obtain the necessary consents from lenders and landlords (where applicable) Decide on the right form of joint ownership. Arrange for all parties to sign and witness the legal documents.
In Ontario, title transfers can only be completed by a lawyer. This ensures the change of ownership is documented accurately, and keeps you, the buyer, from being burdened with the details and complexities of the title transfer process.
