Step-by-step guide to drafting a postnuptial agreement Step 1: Understand the purpose. Before you start drafting, grasp why youre doing this. Step 2: Itemize your assets and liabilities. Step 3: Determine how property will be divided. Step 4: Consider spousal support. Step 5: Put it in writing.
A prenup is more likely to be enforceable than a postnup if one of the signers attempts to dispute it following dissolution of the union. Divorce courts tend to presume that coercion is less likely when independent people are signing before they are actually married and have mixed their assets.
As long as your agreement fulfills Californias legal requirements, the courts will consider it valid no matter how long you have been married. In fact, postnuptial agreements are most common among couples who have been married for years, as they understand better how much each party has to gain or lose.
Before proceeding with a postnup, its also worth keeping in mind that these agreements are easier to enforce in some states than in others. Most courts tend to uphold the agreements as long as theyre written, signed without coercion, and involve a full disclosure of financial information on both sides.
In California, you can write your own postnuptial agreement, but this option is not recommended. These agreements must meet numerous legal requirements to be considered valid and enforceable by law, and most non-legal professionals simply do not possess the knowledge and resources to draft a sufficient agreement.
Postnuptial contracts are only enforceable if they are in writing and signed by both parties, with witnesses present.
Possible cons of postnuptial agreements include: Potential for creating mistrust or tension in the relationship. Emotional stress during negotiation. Limitations on future financial flexibility. Invalidation risks due to improper drafting or execution.
Now, postnups are a different animal than prenups, in that they are not as widely accepted. Some states will not enforce them. Some states enforce them as commonly as prenups. If you are able to obtain a postnup in your state, they allow you to separate your finances.
