This notice is to advise you of your rights under Minnesota law in connection with the improvement to your property. Any person or company supplying labor or materials for this improvement may file a lien against your property if that person or company is not paid for the contributions.
Mechanics lien priority Since mechanics liens relate back to the start of work (defined as the first date of actual physical improvement to the property), they can take priority over a mortgage if the first labor or materials were furnished to the property prior to the date the mortgage was filed.
How Is Priority Determined? Liens generally follow the first in time, first in right rule, which says that whichever lien is recorded first in the land records has higher priority than later recorded liens.
