Patient photographs for treatment are considered part of their medical record. Consent is required for pictures used beyond direct patient care, such as for educational, research, or publication purposes.
Generic hospital clothing and loss of privacy and dignity strip a patient of their unique humanity. Photographs that show the patient when they were well can provide a unique window into a patients life as well as serve clinical purposes.
Most Covered Entities would regard taking pictures without consent (for a use or disclosure not permitted by the Privacy Rule) a grave violation of privacy and you would likely be fired or, at best, given a written warning and required to undergo refresher compliance training.
