How to file Form TM-P for the Registration of Trademark Ownership Transfer? Step 1: Making an Application. The first step is to make an application for the Trademark Assignment in Form TM-P. Step 2: Applying to the Registrar. Step 3: Direction from the Registrar. Step 4: Advertisement. Step 5: Transfer of Ownership.
An assignment form must be submitted to the USPTO listing details such as the trademark registration number, a description of the trademark, and the contact information for the seller and the buyer. This can be done with a paper submission or through the Electronic Trademark Assignment System (ETAS).
The assignor or assignee, or both, can make a joint request to register the assignment by filing an application of a trademark assignment in Form TM-P to the register of trademarks. Form TM-P must be filed with the registrar of the trademark within six months from the date of the assignment.
If youre assigning a registered trademark, you should register the transfer of ownership with the Canadian Intellectual Property Office (CIPO). If your mark is unregistered, you dont have to register the transfer.
To assign ownership to another party, there needs to be a contract agreement between the current owner (the assignor) and the proposed owner (the assignee). This agreement will need to be signed by an authorised person.
A trademark registration fee starts from ₹4,500 to ₹9,000. Small businesses, startups, sole proprietorships, and individuals are eligible for the lower trademark fee of ₹4,500. For other entities, the government trademark registration fee is ₹9,000.
A trademark registered in India is never valid in other countries, as India is different territory, and the trademark registration remains valid only in that territory.
A trademark sale is possible in India. Through the Trademark assignment process, the owner of a trademark can sell it to any individual or legal body. By doing so, the trademark owners rights transfer to an individual or entity. The provisions of the Trade Marks Act, 1999 govern the trademark assignment procedure.
