When you add someone to your homes deed, they gain legal ownership rights. If they face financial difficulties, their creditors might place a lien on your property. Moreover, if your child goes through a divorce, their spouse could claim a share of your home.
If you add your spouse, that means he has the same interest in the property as you do, and you cant sell it, make improvements, or do anything else to change it without his consent. Adding your spouses name to the deed will expose your property to any judgments against him.
You can easily add him to the title to the property by using a Quit Claim Deed. However, there is no way to add him to the mortgage legally without having the mortgage agreement modified with the lender and having him sign a mortgage modification agreement with you and the lender.
Its possible to combine them. You may also know that, like a mortgage, a line of credit can be registered against your home, allowing you access to a lower interest rate. What you may not be aware of is that these two financial products can actually be combined into one.
The mortgage is a separate financial agreement between the borrower and the lender, and adding a person to the deed doesnt affect this contractual relationship.
Remortgaging is the standard way to add someone to a mortgage. If you approach your existing lender, they will undertake the new application and assist with any questions you have along the way. It isnt advisable to just accept a remortgage offer from your existing lender.
Deed vs mortgage which is more important? A house deed and a mortgage are both important aspects of owning a home. However, when it comes to establishing home ownership, the deed is more important. When a person has their name on the deed, it means that they hold title to the property.
In other words, if your name is on the deed, you are tenants-by-the-entireties, and if one of you dies, the other owns the property entirely. If you are not on the mortgage for whatever reason, you are not liable for paying the mortgage loan. That said, you get your spouses interest in the property if they die.
