How can I use a copyrighted image? Paid licensing. A licensing fee is paid to use the image. Fair use. In the case of fair use, the copyrighted picture can only be used for educational, personal or research purposes, or if its beneficial to the public. Creative Commons (CC) Public domain.
To determine usage fees, you first have to calculate a Base Usage Rate (BUR). Generally the BUR is set at about 5-10% of your day rate. The next thing to consider is how long the image will be used for. The longer the usage, the higher the usage fees will be.
The Base Usage Rate (BUR) is a fixed-figure sum set by the photographer or their representative and used to calculate the fees for any additional use of the commissioned work, over and above the original rights granted with payment of the original invoice total.
A photography usage rights agreement is a legal contract that allows you as the photographer or image owner to grant specific use cases to an individual or company. Photography, similar to other artwork, is protected under copyright laws.
Read through the lines though, and you can extrapolate that you should absolutely be charging for your images to be used in publications. Photographers want $100 $500 per image to be licensed in publications. The average going rate for licensing to larger tier magazines is about $300+ per image.
In short: If you created an original image, you own it. That ownership gives you exclusive rights to display and reproduce what you create. If you didnt create it, you need permission to use it.
