Workers' compensation favors the employee – receiving benefits does not require proving anyone's fault for the injury or illness. It is also not a requirement for employees to stop working while on workers' compensation benefits.
Salaried employees can calculate their AWW by dividing their annual salary by the total number of days worked in the 52 weeks preceding their injury, to get their daily wage.
AWW is calculated by dividing the amount you earned in the past 52 weeks by 52. If you earn 80% of your AWW, you will not be entitled to any supplemental wages.
Workers' comp in Texas lasts the entire lifetime for the claimant when it pertains to the medical care that the claimant receives. In other words, for your entire life the workers' compensation insurance company is supposed to pay for all your medical pay that you need for your injury.
Average Weekly Wage (AWW) Your average weekly wage is based on your earnings for the 52 weeks prior to the date of injury. Your AWW is based on your gross earnings, not your take-home pay, and includes overtime.
Understand Worker's Compensation Terms Under Wisconsin's Worker's Compensation statute, an employer's worker's compensation insurance carrier is obligated to pay the injured employee two-thirds of his or her “average weekly wage” (AWW) for each week or partial week of absence due to the work injury.
Once you have the estimated annual payroll for the employee, divide that number by 100. You then multiply that number by the premium rate for the class code to find the total cost of workers' compensation insurance for that employee.
Average weekly wage refers to the total earnings the worker earned from the employer for the year prior to the injury or illness. If you normally work five days per week, your AWW will be set by dividing your total salary by the total number of days paid. This yields your average daily wage.
The benefits are calculated at 66 2/3% of the employee's average weekly earnings as of the date of the injury, not to exceed a maximum amount set by the law. However, if you suffer from a permanent partial disability, you may receive a lump-sum payment based upon the nature and extent of the disability.
Impairment benefits are paid at 75% of your average weekly temporary total benefits. This is normally your weekly compensation rate. If you return to work and are earning pre-injury wages, these benefits are reduced by 50%.
