Under the regulations, USCIS has the discretion to issue Requests for Evidence (RFEs) and Notices of Intent to Deny (NOIDs) for immigration benefit requests in appropriate circumstances. USCIS also has the discretion in some instances to issue a denial without first issuing an RFE or a NOID.
It means that the USCIS officer reviewing your application needs more information before he or she can make a decision. An RFE does not mean that your application is going to be denied or even that it is more likely to be denied than if you hadnt gotten the RFE.
Applications and petitions filed with U.S. Citizenship and Immigration Services on or after Sept. 12, 2018, are subject to the agencys new policy allowing a denial without first issuing a Request for Evidence, or RFE, or Notice of Intent to Deny, or NOID.
Written by Jonathan Petts. Step 1: Make a Copy of the RFE Notice. Step 2: Gather the Requested Evidence. Step 3: Prepare Your RFE Response Packet. Step 4: Mail Your RFE Response Packet to USCIS.
Having worked at USCIS for over a decade, specifically in Customer Relations, which is involved in this kind of thing, I can say that yes, you can send documents to USCIS without an RFE.
Applicants can submit unsolicited evidence at any point until USCIS decide the case. Unsolicited evidence may include a clarification or correction. The best way to make sure USCIS reviews all your evidence is to have it ready and submit it when you apply.
In short, Yes, you can try to send more evidence, but that doesnt mean USCIS will accept it.
