What Does Publication Mean? When a U.S. patent application is published, the patent application is made publicly available for download (see Sample Published Patent Application) and entire file history for the patent application can be viewed by anyone using Public PAIR.
The publication date is the date on which a patent application is first published. It is the date on which the document is made available to the public, thereby making it part of the state of the art. European patent applications are generally published 18 months after the date of filing or earliest priority date.
A patent of addition should either be on the same date or a date later than the date of filing of the main application. Therefore, in principle, a patent of addition can be filed even after the grant of the main application.
Related provisions in the Patents Act, 1970 ing to the provisions of this Section, If an applicant feels that he has come upon modification or improvement of an already patented invention, another application can be made for a patent of addition in respect to such improvement or modification.
Utility and reissue patents are issued within about four weeks after the issue fee and any required publication fee are received in the Office.
If the patent application was filed before June 8, 1995, the patents term is 17 years after the grant date of the patent. The patent grant date is listed at the very top of the information page, on the right side, under the patent number.
The priority date is the first date of filing of a patent application. It is essential for determining whether any subsequent application for the same invention can still be assessed as novel. It also makes it possible to determine whether the subject-matter of a patent application is prior art on a particular date.
You cant patent an existing or old product. However, you can patent an improvement to an old product or a new use for an existing or old product as long as the new use is nonobvious. Moreover, the new use cannot be inherent in the use of the existing or old product.
If you own a patent, you have possession of a product or design and others cannot make, sell, or use it. The U.S. Patent and Trademark Office (USPTO) grants patents for improvements made to existing products or innovations similar to already-patented products.
Priority date refers to the earliest filing date in a family of patent applications. Where only a single patent application is involved, the priority date would obviously be the filing date of the sole application.
