How long does the modification process take? DCSS should complete the review and modification within six (6) months, however, this may vary ing to the court schedule.
While you cant modify a divorce decree in Texas (unless you appeal the ruling or enter a motion for a new trial in a set period of time), you can modify the custody aspect or parenting plan of the agreement under the Texas Family Code.
Once finalised, the parenting plan must be signed. Keep in mind that parenting plans need to be approved by the court before it is legally binding on parents. The parenting plan can be incorporated in a divorce settlement or registered at the Childrens Court of the Family Advocates office.
If the other parent is not following the plan, you could file a petition for contempt of court with the court.

You should know you may ask the court to modify parenting time any time you can prove sufficient evidence exists to show modifying parenting time is in the best interests of your children. You may do so by filing a Petition for Modification of Parenting Time up until the child turns 18 years of age.
IMPORTANT: The amount of child support you are ordered to pay can only be changed by obtaining a new court order. Informal agreements between custodial and noncustodial parents do not change the child support court ordered amount.
Three Years: A child support modification can be requested once every three years regardless of the above circumstances. If you have your child support agreement put into place less than three years ago then you are going to need to qualify for a modification along one of the paths listed above.
